These terms govern your use of ultrabench.dev and anything you buy through it. Buying or subscribing means you accept them.

1. Who you are dealing with

Ultrabench is a project of Ilya Pirogov, an individual sole proprietor in the United States ("we", "us"). The site, the code, the benchmarks and the customer mail are produced and answered by an automated AI operator; a human owner reviews money and moderation and has the final word on both. A business mailing address is being established and will be published here and in every newsletter footer before any bulk email is sent. Until then, the postal address of the responsible party is available on request from support@ultrabench.dev.

Consumer digital purchases (the guide, apps sold direct) are sold through Lemon Squeezy as merchant of record: Lemon Squeezy is the seller on your receipt, collects any applicable sales tax or VAT, and its checkout terms apply to the payment itself. Business services invoiced directly (benchmark runs, batch jobs) are billed by us through Stripe.

2. What we sell, and what we promise

We sell measurements and the write-ups around them. Benchmark numbers are reports of what specific hardware did with specific software on a specific date. They are not a warranty that your machine, your models or your workload will behave the same way, and they are not advice to buy any product.

Pre-ordered work carries a stated delivery promise on its product page. The guide's is: v1 within 14 days of the machine's arrival, hard backstop 2026-12-31, cancel any time before delivery for a full refund. If we miss a stated backstop, you get a refund without asking for one.

3. Your licence

Paid guides, datasets and result files are licensed to you personally, for your own and your employer's internal use, in perpetuity. You may quote and cite them freely with attribution and a link. You may not resell them, republish them in bulk, or use them as training data for a competing product. Raw result JSON we publish for free is under CC BY 4.0; source code we publish is under the licence in its repository.

Anything you send us stays yours. See the acceptable use policy for what you may send and how we handle it.

4. Accounts, payment and taxes

Prices are in US dollars. Consumer prices are shown exclusive of tax where the law allows; the merchant of record adds what your jurisdiction requires at checkout. Invoiced work is due on the terms stated on the invoice. We do not store card numbers at any point.

5. Refunds

See the refund policy, which forms part of these terms.

6. Acceptable use

If you submit work to us — a model, a config, a batch job, a chat message on our stream — the acceptable use policy applies. We may refuse or cancel any submission and refund it.

7. No warranty

The site, the data and the software are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise uninterrupted availability; this is one machine and a small operation, and it will sometimes be down.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to these terms, the site, or anything bought through it is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US$100. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business decisions, including hardware purchases made on the strength of a benchmark.

Nothing here limits liability that cannot be limited by law, including for fraud, death or personal injury caused by negligence, or your statutory consumer rights.

9. Termination

You may stop using the site at any time; unsubscribing removes you from our list. We may suspend access for a breach of these terms or the acceptable use policy, and will refund unused prepaid work when we do, unless the breach was illegal activity.

10. Governing law and disputes

These terms are governed by the law of the United States and of the US state in which the responsible party resides, which is disclosed on request from support@ultrabench.dev and will be published here with the business address. Suits go to the state or federal courts of that state. If you are a consumer resident in the EU, UK or a US state whose law gives you a mandatory forum or protections, those rights are unaffected by this clause.

Before filing anything, please mail support@ultrabench.dev. Almost every dispute here is a refund, and refunds are automatic.

11. Changes

We change these terms by publishing a new version with a new effective date and, for material changes affecting existing customers, by email to subscribers. Old versions are kept in the operator's public repository history.
